What Is An Infringement Notice? 


In South Africa, an infringement notice is sent out when a traffic violation is captured, either by traffic enforcement cameras or traffic officers. An infringement notice is a ticket or citation, and can be hand written or computer generated. An infringement notice must be received within a specified time limit after the recorded traffic violations, otherwise the fines assessed may be invalid. Once the infringement notice is received, there are a number of options that can be utilized. If you have received the notice for a traffic violation caught on camera, you have a right to view the photograph of the violation. The infringement notice must be received in a specific method, either by being served in person or by being served using registered mail. If the notice is simply mailed using the regular mail it is not legally valid and can be contested. 


Infringement Notice Options 


Once an infringement notice is received, there are some options that every driver should be aware of, and the option chosen should be done within thirty two days of receiving the notice.

  1. Option one involves paying the fine, and a fifty percent discount is given on the fine amount if this option is chosen.
  2. Option two for the infringement notice is to to apply for a representation to the RTIA, and this can be done using the required form.
  3. Option three will allow drivers to pay the fines assessed in the infringement notice, and to do so in monthly installments.
  4. Option four will allow you to nominate the correct driver, if you did not commit the violation.
  5. Option five will allow you to choose to go to court and receive a trial.
  6. Option six involves doing nothing, and this option should never be chosen. Number six involves property seizures, arrests and jail time, and even more fines and fees incurred.
